Arrest Mayors/Police Chiefs of Sanctuary Cities

Donald Trump wants to deprive sanctuary cities of federal funds, but there is an easier way of stopping the practice of providing "safe haven" for illegal aliens.  Arrest and convict the mayors and police chiefs of those cities that are in violation of federal law.

U.S. code "1907. Title 8, U.S.C. 1324(a)" states this:
"Harboring -- Subsection 1324(a)(1)(A)(iii) makes it an offense for any person who -- knowing or in reckless disregard of the fact that an alien has come to, entered, or remains in the United States in violation of law, conceals harbors, or shields from detection, or attempts to conceal, harbor, or shield from detection, such alien in any place, including any building or any means of transportation."
There is no question that these mayors and police chiefs in these cities, are both "knowing", and "in reckless" disregard of illegals in their communities.

Further, this U.S. code also states:
"The basic statutory maximum penalty for violating 8 U.S.C. § 1324(a)(1)(i) and (v)(I) (alien smuggling and conspiracy) is a fine under title 18, imprisonment for not more than 10 years, or both."
Additionally:
"...the basic statutory maximum term of imprisonment is 5 years, unless the offense was committed for commercial advantage or private financial gain, in which case the maximum term of imprisonment is 10 years."
More importantly, there is provision of the law:
"...if the violation results in the death of any person, the defendant may be punished by death or by imprisonment for any term of years."
Someone might remind San Francisco Mayor Ed Lee of that latter provision.  He was the mayor when Kathryn Steinle lost her life to a gunshot from an illegal alien in that declared "santuary city".  In fact, statistically, there are more than 820,000 criminal illegals in this country; of which 84% have either committed felonies and/or serious misdemeanors.   That's one-in-twelve who have violated our laws since they originally violated the law by coming into the country illegally.

In my opinion, arresting and trying mayors like Bill DeBlasio (New York City), Rahm Emanuel (Chicago), and Ed Lee (San Francisco) would be a much more powerful message than simply stripping their federal funds.

Tax Payer Money for Illegal Alien Healthcare?

One provision of the Affordable Care Act (aka Obamacare) says this:
Section 1332 of the Affordable Care Act (ACA) permits a state to apply for a State Innovation Waiver to pursue innovative strategies for providing their residents with access to high quality, affordable health insurance while retaining the basic protections of the ACA.
State Innovation Waivers are available beginning January 1, 2017.  State Innovation Waivers are approved for five-year periods, and can be renewed.  Waivers must not increase the Federal deficit.
Well, it now appears that California is poised to take advantage of this provision by submitting a waiver request that would allow illegal aliens to buy insurance in California's ObamaCare exchange.  California expects that this waiver would benefit 50,000 of the state's 2.6 million illegals.  The state is emphasizing that subsidies are not being requested  along with this waiver. The hope is that this will be reviewed and approved after January 1, 2017 and before Obama leaves office on January 20, 2017.

In my opinion, this is less about helping illegals get access to health insurance and more about helping the state's Democrat in an election year.

First of all, the number being helped by such a waiver is quite small, at less than 2% of the Illegal population of California.   I also think that the estimate of 50,000 is still too high because the cost of healthcare premiums -- without subsidies -- will make this insurance unaffordable for most illegals.  But never mind that. Some believe that this waiver request is a migration strategy that will lead to illegals getting federal subsidies in just a few years. Also, illegals may not want to buy insurance in the exchanges for fear of exposure.

Right now, California's 2.6 million illegals are getting their healthcare -- for free -- by simply going to any hospital that accepts Medicaid patients by taking advantage of the federal law known as the Emergency Medical Treatment and Active Labor Act (EMTALA).  That law allows any foreign national to receive healthcare regardless of their ability to pay.  So, why would they give up free for paid healthcare in the exchanges?

If illegals do get federally subsidized insurance, it will be another broken promise by President Obama who, in 2009, said this:
“There are also those who claim that our reform efforts would insure illegal immigrants. This, too, is false. The reforms that I’m proposing would not apply to those who are here illegally.”
Again, this is all about politics and about Democrat's hopes that Hispanics remain a solid voting block for them; both in this year and in the future.  Their biggest hope is that, someday, 10 million illegal Hispanics will become citizens and, as such, instant Democrats.

Is Mexico Dumming-Down the U.S.

President Obama, as well as many other Democrats, continually tell us that immigration makes America stronger.  But not if those immigrants are so poorly educated.

The 1980 Census Bureau data said that the U.S. Hispanic illiteracy was 14.7%; with those of Mexican origin having a 26% higher illiteracy rate of 18.5%.  So, inversely, U.S. Mexican literacy was 81.5%.  What's interesting about the latter number is that it closely matches the literacy rate in the country of Mexico which stood at 82.9% in that same year.  In other words, Mexico had a 17.1% illiteracy rate.

Now, fast forward to today.

In this country, Hispanics now have a 41% illiteracy rate.  Under the assumption that Mexicans have a 26% higher rate in 1980 than other Hispanics, this means that this country's Mexicans just might have an illiteracy rate as high as 52% in isolation from other Hispanics.  While, at the same time, in Mexico, that country's illiteracy rate has fallen to just 5.8%.  So, this begs the question.  How is it possible that the population in Mexico is so much smarter today than it was in 1980? Similarly, why is it that our Mexican population has gotten so much dumber? Is it possible that the influx of Mexicans are the least literate and least employable of Mexico's society?  If so, this country is not being strengthened by immigration and Obama is just plain wrong.

Trump Is Right. Illegals Have High Rates of Crime

11 million illegal immigrants make up 3.4% of this country's population. Yet, depending on which study you look at, the incarceration rates for illegals is many times that percentage.  For example, in 2004, the Department of Health and Human services found that 22% of the people in our state prisons were foreign born. The Federal Bureau of Prisons found that 26% of its inmate population were non-citizens.

In January, a Senate committee headed up by Chuck Grassley found that 1,000 of the 36,000 illegals released by the Department of Homeland Security went on to commit crimes. One of those released, as reported by the Washington Times, went on to commit the following: "convicted of inflicting injury on a domestic partner; child cruelty, with the possibility of injury or death; probation violations; speeding; driving without a license; and failing to appear for court."  The fact is that Hispanics represent 40% of federal crimes in this country of which 72% of those crimes are committed by non-citizen Latinos (see Wikipedia reference below).

In addition to all of the above, it now appears that some of the children crossing our border are members of the notorious and violent gang: MS-13.

The political left doesn't want you hear these kinds of facts because it could derail President Obama's and other Democrat's push for amnesty.  Ever since Donald Trump said that illegals were bringing crime, the left-leaning media has done everything possible to discredit him,  but the recent murder of a women in San Francisco by an alien who had been deported 5 times has brought Trump's words into a new light.

To counter that San Francisco killing, all you hear from the political left is that you can't use this one incident as an example that illegals commit crimes.  Really?  They should look at the stats. Illegals, in general, commit crimes at a rate that is at least 6-1/2 times higher than their population.

Don't Give Illegals Social Security Numbers. Give Them Tax I.D.'s

If President Obama gets his way, amnesty to illegal aliens will include the issuance of Social Security numbers.

This is just plain wrong. A Social Security number gives them access to all too many federal and state services as benefits including the ability to easily register to vote, which would be a federal crime.  Under the Motor Voter law anyone with a valid Social Security number can register to vote anytime they apply for or renew a driver's license or sign up for public assistance.  No proof of citizenship is required. A Social Security card also allows them to file a tax return and get a refund under the Earned Income Tax Credit that is in excess of any taxes they many have paid and/or may have been refunded.

None of these things are afforded to legal foreign residents who live and pay taxes in this country because they typically don't get Social Security numbers, they get an Individual Taxpayer Identification Number (ITIN).  The ITIN looks exactly like a Social Security number but the lead digit is a "9", which serves as a red flag that the person holding that number is a guest in this country and not a citizen.  The ITIN serves the purposes of collecting taxes and Social Security/Medicare payroll taxes (FICA, but negates the ability of the holder to file for an Earned Income Tax Credit refund.

Congress should act now to insure that, if Obama is allowed to give amnesty to illegals, they are only eligible for Individual Taxpayer Identification Numbers starting with the digit "9". Otherwise, a new study has shown, that many illegals could file tax returns for the last 4-years and get up to $35,000 in retroactively paid Earned Income Tax Credits.

Obama's Choice For Illegals: Unemployment In Exchange For Amnesty?

By all accounts, President Obama's executive order will give at least 4.5 million illegals with U.S. born children permanent and legal residency through the existing green card system.  As a result they  will no longer have to work in the shadows; constantly in fear of deportation.

What the executive action ignores is the fact that many employers, not all, hire illegal workers because they will accept low wages, work hard, work long hours and, more importantly, won't complain about either their pay or their working conditions.  In return, there is also an implied agreement that the employer won't turn them in to immigration authorities, unless of course, they give them a reason to do so.

So, what happens when the fear of deportation is taken away by executive action?

First of all, you need to understand that many of these people can't speak or read English.  Some are unable to read in their native language as well, being illiterate and having limited job skills.  So, if it weren't for the fact that employers can get away with paying low wages, these people would normally be unemployable.  And, that's exactly what Obama's executive action may do.

After becoming legal residents with their green cards in hand, those once-illegals must be lawfully paid at least the minimum wage or the prevailing wage for the kind of work being done.  Thus, the low pay advantage goes away.  Also, their newly found status means that they no longer have to fear exposure and possible deportation; so, they are free to complain about salary, working conditions, and long hours.  In essence, they will become no different than any other U.S. born worker.

Ultimately, employers will begin to hire better educated, English speaking, literate Americans over the former illegals.  What we will then wind up with is some number (possibly in the millions) of unemployable workers who will, because of their legal status, be wards of the state; living off of welfare and other poverty benefits.

Thank you, Mr. Obama!

The Blame-Game and Lies About the Border Immigration Crisis

The explosion of unaccompanied children crossing our southern border -- up 92% just this year under Obama's watch -- has caused the President and the Democrats to find anyway possible to blame the Republicans -- and even George W. Bush -- for this crisis.

Obama blames the Republicans for not passing immigration reform. However, there isn't a single,  change in the proposed policies -- from either the Democrats or the Republicans -- that would have prevented or stopped this current wave of children from asking for asylum from violent countries like El Salvador, Honduras, or Guatemala.

They are coming here because they are aware of an existing law --  the Trafficking Victims and Violence Protection Act -- which mandates that border agents must accept any child into this country who is seeking asylum from violence in their own country.  And, they can't be deported without having  a legal hearing as to whether or not they were truly endangered. Even if we added 700 miles of new fencing, any of these children could go to a cross-border checkpoint, and our agents must accept them.

Now, with regard to the Trafficking Victims and Violence Protection Act, there are those who are attempting to blame George W. Bush for its reauthorization in 2008. But, there are three facts that aren't being told about the 2008 law.  First, it was originally signed by Bill Clinton in 2000 and had to be renewed several times because it always carried an automatic sunset date.  The 2008 renewal not only pertained to human trafficking, but also included a new amendment covering asylum for unaccompanied alien children fleeing violence. That amendment was written and promoted by a Democrat, Senator Dianne Feinstein, in her role as the Chairperson of the Democrat-controlled Senate Judiciary Committee.  Bush may have signed it into law but the "unaccompanied rule" was a Democrat-led initiative. Secondly, it expired in 2011 and had to be reauthorized and signed by President Barack Obama in 2013.  This 2013 reauthorization seems to have been the impetus for the current wave of children exploding into the crisis we are now seeing.

So, it's pretty simple.  If the Trafficking Victims and Violence Protection Act is repealed or amended, the problem would, in all probability, go away.  However, none of our politicians -- on either side of the political aisle -- are going to put their name on a law that would heartlessly return children to a life of violence and possible death.  Personally I don't see any way of ever stopping this.

However, what I am afraid of, is that many politicians will push for reuniting these children with their parents in "this" country and not their own.  If this does happen, it will create a new method for immigrants to gain legal access into the U.S. by simply sending their kids to the border.  Thus, they will succeed in bypassing our existing legal immigration laws.  And, the surge of aliens into our country will only be amplified.
