Arrest Mayors/Police Chiefs of Sanctuary Cities

Donald Trump wants to deprive sanctuary cities of federal funds, but there is an easier way of stopping the practice of providing "safe haven" for illegal aliens.  Arrest and convict the mayors and police chiefs of those cities that are in violation of federal law.

U.S. code "1907. Title 8, U.S.C. 1324(a)" states this:

"Harboring -- Subsection 1324(a)(1)(A)(iii) makes it an offense for any person who -- knowing or in reckless disregard of the fact that an alien has come to, entered, or remains in the United States in violation of law, conceals harbors, or shields from detection, or attempts to conceal, harbor, or shield from detection, such alien in any place, including any building or any means of transportation."

There is no question that these mayors and police chiefs in these cities, are both "knowing", and "in reckless" disregard of illegals in their communities.

Further, this U.S. code also states:

"The basic statutory maximum penalty for violating 8 U.S.C. § 1324(a)(1)(i) and (v)(I) (alien smuggling and conspiracy) is a fine under title 18, imprisonment for not more than 10 years, or both."

Additionally:

"...the basic statutory maximum term of imprisonment is 5 years, unless the offense was committed for commercial advantage or private financial gain, in which case the maximum term of imprisonment is 10 years."

More importantly, there is provision of the law:

"...if the violation results in the death of any person, the defendant may be punished by death or by imprisonment for any term of years."

Someone might remind San Francisco Mayor Ed Lee of that latter provision.  He was the mayor when Kathryn Steinle lost her life to a gunshot from an illegal alien in that declared "santuary city".  In fact, statistically, there are more than 820,000 criminal illegals in this country; of which 84% have either committed felonies and/or serious misdemeanors.   That's one-in-twelve who have violated our laws since they originally violated the law by coming into the country illegally.

In my opinion, arresting and trying mayors like Bill DeBlasio (New York City), Rahm Emanuel (Chicago), and Ed Lee (San Francisco) would be a much more powerful message than simply stripping their federal funds.

Obama's Executive Order To Give Illegals Amnesty May Backfire On Democrats In The Fall

President Obama and the Democrats feel they are on the winning side of immigration reform; and, they believe that Republican inaction on the issue will only cause losses for them in the Fall.  That belief is based on recent polling of a cross-section of all Americans.  In addition, it now appears that Obama may sign an executive order which could give as many as 5 million of the 11 million illegal aliens some form of amnesty.  Of course this comes after more than 5-1/2  years of doing nothing.  Proving again that the President's only reason for this action is the upcoming mid-term elections.

The problem with Obama doing this on his own is that, while American's want reform, the last thing they want is amnesty.  In fact, a July 18-20 CNN/ORC poll showed that 51% (35% Democrats, 49% Independents, and 76% Republicans) wanted the most extreme level of reform, with not only the border being shutdown but with people being deported.  This is up 41% from a similar January 2014 poll.  Even Democrats have moved towards supporting deportation, with their number going up from 27% in January; indicating that the current flow of unaccompanied children has soured the entire country on any easing of access to our southern border.

Even worse, in a 2013 Latin Opinion Poll, most Hispanics (60%) in this country don't want amnesty given unless the border is shored up, and they also favor increased enforcement.  56% said illegals shouldn't get any Federal benefits and also, of those polled, 64% said e-Verified should be used to screen illegal immigrants when applying for work.

So, if Obama does provide amnesty to nearly half of all the illegals, it just might backfire on him.  Instead of solidifying the Democrat/Hispanic vote, it may in fact cause an angered and increased turnout against Democrats.  Even by Hispanics. Just in the same way that the passage of ObamaCare swung the House of Representatives from Democrat to Republican control in 2010.  This time, the Senate would fall victim of the President's lawless, executive order.  Of course, this is just my opinion.

There Are Illegal Immigrants And, Then, There Are Illegal Immigrants

Since the beginning of the year, the talk of immigration reform has almost reached a fever pitch. Mainly, because Democrats want to use it as a wedge issue in the run up to this Fall's elections. But, in the minds of most Americans, immigration reform is all about those Hispanics they read about who are entering our southern borders without papers, passports, or invitations.

The real fact is that anywhere from 40 to 45% of all illegals in this country came here as invited guests of our government and just never went back home. They came here on work and student visas and, even as tourists with valid passports and travel visas.

For this reason, I think any type of immigration reform must consider the fact that there are really several classes of illegals and each should be treated separately.  In my opinion, someone overstaying their welcome is a less egregious wrong than someone who, from the very onset, was never invited and totally ignored our immigration laws.  As such, they should have the least easy pathway to citizenship and should have to pay penalties for doing so.

Those who should have the easiest path to citizenship should be those who overstayed their work visas or green cards.  They got here because our government felt they would be a valuable asset in that they would be able fill some of the experience-level or educational voids in our workforce.  Most all are highly educated and experienced English-speaking professionals in valuable career fields like computer sciences, engineering, health care, medicine, and research.

Similarly, students who overstayed their educational visas are also valuable; especially if they completed their education.  Like the group above, they are all English-literate; otherwise they would not have been able to pass the admissions tests. With some college or a degree, they have a low chance of being a drag on our economy by being unemployed.

The last group would be those who overstayed their tourist visas and those who came across our northern and southern borders.  I agree with the many pro-immigration reformers who believe that, before any of them can be eligible for citizenship, they should be able to speak English, pay a fine or penalty for coming here illegally, and show proof of employment. Only then should they be allowed to go to the back of the line for legal immigration (ie. green card or work visas) with a possible pathway to citizenship.

The Lawlessness of the Obama Administration

Under our Constitution, it is the Congress who makes the laws; that's why we refer to Congressmen and Senators as "lawmakers".  The responsibility of the Executive Branch is to execute and administer those laws, and it is the responsibility of the Judicial Branch to pass judgement on anyone who is suspected of breaking them.

Nowhere does our Constitution give the Executive Branch the ability to decide which laws are or are not to be enforced. Yet, last Friday, President Obama did just that by sidestepping Congress and granting certain illegals the right to be in this country legally, and attend school and work without the threat of deportation or imprisonment.

This is not the first time that Obama's people have refused to pursue and prosecute certain offenders of the laws of this nation. The Obama Justice Department did it when it refused to prosecute the New Black Panthers for polling place intimidation during the 2008 elections.   The same Justice Department has done it by ignoring the mandates of the Defense of Marriage Act.  Obama, himself, did it by making recess appointments while Congress was in still in session under the rules that define a "pro forma" session.  Then, too, Obama forced Catholic institutions to provide contraception when, in fact, the Constitution provides for free and clear practice of religion without federal intervention.  And, the list goes on.

Not since Richard Nixon have we had an Executive Branch who has so blatantly ignored the laws of the land and the Constitution.  I guarantee that Obama will only become a bigger violator if he is allowed to serve a second term.

Pathetic Harry Reid On Immigration and Construction Jobs

In a recent interview, Harry Reid claimed that no illegal immigrants were taking high-paying construction jobs away from American workers in the state of Nevada as seen in this clip:



Obviously, this report (at the very end) refutes Reid's claim by clearly using pertinent data from the Pew Research group.

Actually, I think the number of illegals is quite a bit higher than what was stated here as well. I live in Las Vegas and at most construction sites, English is the forgotten language. In most cases, approaching any Hispanic looking worker on a construction site and asking for the time of day, will get you a blank stare before being pointed in the direction of the one worker designated as the official "interpreter" for that job site or work crew.

Harry doesn't want to destroy the big Democrat lie that illegal immigrants are only here to take the jobs that Americans won't do. Apparently, he doesn't seem to understand that illegals are throwing a lot of Americans into the unemployment lines because they are willing to undercut the salaries that are usually demanded by American workers. As a consequence, employers will gladly fill any vacancies with illegals. That is, if they think they can get away with it!

Render Unto Caesar The Things That Are Caesar's

As expected, Obama's Federal Justice Department filed suit against Arizona for trying to aid in the enforcement of U.S. immigration laws through its own, recently-passed, but not yet implemented, legislation. In doing so, the Feds are basically telling Arizona, or any other state for that matter, that they are not responsible for enforcing a law that is "the" sole responsibility of the Federal government.

Well, if the states aren't responsible for assisting the Feds in the pursuit of any Federal violators -- such as illegal immigrants -- then, it is only logical, that the states completely ignore any outstanding Federal warrants or violators of any and all Federal laws. The Federal government cannot just pick and choose which laws they expect the states to assist them with and which ones they don't. In my opinion, to ignore some Federal violators while assisting in the prosecution of others is to ignore the "equal protection" clause of the United States Constitution.

The President, a trained Constitutional lawyer, should understand this. But, as usual Obama says screw the Constitution when any political gains are achievable!

Ignoring The Truth About Illegal Immigration

Those proponents of illegal immigration always use the excuse that illegals come to this country to take the crap jobs that Americans won't do. This argument is a rationalization that completely ignores the true cause of illegal immigration.

The fact is that the countries with the highest rates of illegal immigration into this country, like Mexico, are countries who have failed their own citizens. They have failed to produce effective economies that would keep their citizens employed; keep them happy in their work; and, keep them from looking elsewhere to survive. Typically, this is because of massive corruption in their governments and because of the high concentration of wealth in the hands of too few people.

Let's face it. We have a Mexican immigration problem because Mexico can't support millions of its own people in anything but a lifestyle that is barely subsistence. A vast country like Mexico has unbelievable wealth in labor; productive agricultural lands; minerals; and tourist attractable coastal and interior areas. Yet, people must leave in order to survive.

It annoys me when President Calderon of Mexico criticizes the U.S. for trying to control illegal immigration when, in fact, it is he and the rest of the Mexican government that have so miserably failed to support their own people. Now, their entire country is on the precipice of becoming a Drug-dom that is headed down the same path as was Columbia with the entire country being controlled by drug gangs and drug lords. If it continues, Mexico will become a real-life version of the society that was portrayed in the movie Mad Max.

The reason that so many illegals proudly wave the flags of their country is because they, in their hearts, don't view America as their new home. Their journey here was actually forced upon them in order to survive. With the exception of those who had children that have been born in America who are citizens, many will go back after amassing enough savings to return home and live their last days in the land that they truly love. A Mexican electrician, who did some work on my house and was most likely here illegally, told me that he eventually planned to retire to Mexico and live out his life as a "royal" because every dollar he made here was so much more powerful when spent there.

I think the Democrats are wrong in assuming that every Mexican or other illegal alien that comes across our border wants to become a U.S. citizen. If they could, based on their pride in the country they left, they would prefer a guest worker program. I believe this should be our major goal in handling the illegal immigration problem in this country.

Illegals Call Now!

Last week, the Department of Labor released this ad:



Of course, the purpose of the ad is obvious. However, the concept is simply ridiculous.

First, illegal aliens are only being hired because they are willing to work for less. If employers were willing to pay a fair wage, they wouldn't be hiring them in the first place. They would be hiring Americans with higher educational skills and, hopefully, no language issues.

Additionally, this ad is asking illegals to look a gift horse in the mouth. If employers begin to fear that illegals are talking to the Department of Labor about them, they will stop hiring them. Now, maybe in a way, this will actually reverse the flow of workers across our borders. But, it is possible that because they are here already, the reduction in jobs for these workers may actually create conditions which force them to make other choices to stay alive; causing crime rates and gang activity to increase.

A Real Life Test Case On The Arizona Immigration Law

If you listen to the detractors of the pending, new Arizona law on immigration, they are saying it will unjustly subject Hispanics to racial profiling. But, what if there was a test case of that law that was already in existence? Then, would we be able to judge if racial profiling was a problem.

Well, guess what? Prince William County in Virginia has an almost identical law to that of Arizona and it has been in effect for the last three years (Click here to See Story: Three year old law in Virginia targets illegal immigrants much like Arizona's SB 1070).

Further, the University of Virginia was been contracted by the police department of Prince William to conduct a series of reports as to the effectiveness and problems associated with that law. The first report, an Interim Report, was issued just last year (Click here to See Report: Evaluation Study of Prince William County Police Illegal Immigration Enforcement Policy INTERIM REPORT 2009 ).

While the report is not that sure of all the downsides and benefits of the law, it specifically reinforces the fact that "racial profiling" has not been a problem since implementation. In fact, no lawsuits have yet to be brought against the county or any police officer for having arrested anyone under the stipulations of the law. The report clearly states:

According to PWCPD data, almost all persons (98%) suspected of being illegal immigrants by officers have turned out to be illegal immigrants, which suggests that police are focusing their enforcement efforts on the proper people. Further, officers have been able to maintain their focus on enforcing the policy with immigrants who commit crimes, with no known cases of officers inappropriately applying the policy.

I know, as of this morning, Obama and his highly political Justice Department led by Eric Holder are now prepared to block the implementation of the Arizona law. One has to really ask themselves: If the law in Arizona is the same as the one in Prince William County, where has the Justice Department been all this time with regard to blocking it in that Virginia county. Simply, it just shows that Obama is again using political theater to secure votes and specifically not do what is right for Arizona; or, for that mater, America!

Mexico's President is Outraged At The Arizona Law!

On our own White House lawn, our constantly apologetic President allowed the President of Mexico to criticize the newly enacted Arizona law (Click to See Full Story: Obama, Calderon criticize Arizona immigration law). This is beyond belief because Mexico has some of the harshest immigration and visitation laws in the Western Hemisphere.

Purely staying in Mexico for any period beyond the time specified in a work permit or visa is a felony; punishable by up to 10 years in prison. Mexicans are encouraged to make "citizen's arrests" of anyone in their country illegally. Then, too, the local police are mandated to assist the Federalis in locating and arresting any illegals.

Even those who are in the country legally are barred from working in the government; as religious clerics; as a pilot; at any of the harbors within the country; and, in any number of occupations that are on the restricted list. Legal visitors can only remain in Mexico as long as they are "physically and mentally healthy". Otherwise, home you go, gringo! Falsification of any documents (like an I.D. or driver's license) or even signing a document using a false name, and you could end up in prison for up to a decade. No foreigner can ever own land or buildings in Mexico. Any person wanting to enter Mexico must provide proof of being able to sustain themselves before entering the country. Only foreigners who can improve Mexican society and not take jobs away from Mexican citizens are allowed into the country.

If we had the same laws as does Mexico regarding immigration, we'd have 10 million or more Mexicans choking our jails for numerous counts of laws broken. President Calderon is a hypocrite who seems to view the USA as some kind of work suburb of Mexico. The guy is the President of a country where corruption is rampant in government; where nearly every cop is on the take for the drug cartels; and, all the wealth is centralized in the hands of a few elites. We don't have millions of illegals here because Mexico is such a great place to live and find a job. Mr. Calderon should go back home and take a few million of all those false ID carrying "guests" along with him and stop whining about the leniency his people are afforded after they illegally enter this country.

The City of Los Angeles: Just Whistling Past The Graveyard?

For the City of Los Angeles, the parallels to the financial woes of Greece, are just too analogous to be ignored. Like Greece, the debt is almost insurmountable. And, like Greece that debt is primarily being driven by lavish union retirement pensions and benefits. And, like Greece, every attempt to cut jobs or reduce retirement spending is blocked in the courts by lawsuits brought by, yes, the unions.

The city is literally at the brink of bankruptcy with a budget deficit of over a half-billion dollars (Click to See Full Story: Is The L.A. City Council In Denial Over Budget Mess?). Yet, the City Council is happily debating anything but the budget woes that could result in the potential collapse of every service that the citizenry of Los Angeles expects from their government.

A case in point was yesterday's City Council vote to boycott $56 million in spending activity with the state of Arizona as punishment for Arizona's supposed "racist" crackdown on illegal immigration. Besides the fact that the City Council hasn't taken the time to either read or understand the Arizona law, it just shows why Los Angeles, and so many other cities in California, are in such trouble. Further, the action by the City Council is pure stupidity because it is totally politically motivated and it actually may hurt those that their actions pretend to protect.

The illegal immigration of today is a vicious business. It truly borders on slavery. The coyotes who guide the immigrants through the deserts to cross our borders are demanding higher and higher pay for their services; with that pay often being in flesh or sexual favors when the cash isn't forthcoming. All too often, the lives of family members, either in Mexico or in the United States, are in jeopardy for failing to pay the coyotes. For this reason and because of, too, the drug trade from Mexico, Phoenix is rampant with kidnapping activity; second only in the world to Mexico City. Yet, resolutions by City Councils, like those in Los Angeles, are misplaced in that their actions will continue this every increasing abuse of human rights and will do absolutely nothing to solve the problem of illegal immigration.

Then, too, the attempts to hurt Arizona by boycotting business activity is probably going to hurt the illegals more than anyone else. When there is a decline in business activity, its always those lowest on the totem pole of employment who suffer the most.

As readers of this blog know, I believe that illegal immigration has done more to suppress good pay in America than help it. As long as there are those who are willing to work at lower-than-low wages and employers willing to hire, there won't be wage pressure from the bottom; as would otherwise be the case in an environment where there isn't 10% of the workforce who is in the country illegally.

A Different Take On Illegal Immigrants

The common argument for allowing illegals to remain in this country is that they take the jobs that Americans won't do. But, in reality, they also take good-paying, non-union, construction jobs and get paid half to a third less than what an American would be paid to do the same job. And, employers know that the illegals won't complain because they could wind up being deported.

In effect, illegals are causing wage suppression in this country. I think, because of that, the Democrats of Congress have seen fit to keep raising the minimum wage.

Employers who hire illegals are getting a deal and, in effect, are using them like slave labor. If there weren't so many who were willing to work for less, than employers would have to hire workers at higher wages to attract Americans to their workplace. But, in reality, just the opposite is happening.

The Democrats are all for the naturalization of illegal aliens because they see votes for their party. But, keeping illegals in this country is harming American wages. I believe strongly in deportation of illegals. But, at the same time, I believe we should have an active guest worker program that gives anyone a decent wage; and, one that gives an American worker the first right of refusal for that particular job.

I live in Las Vegas which has probably the highest per capita concentration of illegals in the country. The availability of tons of low-paying, service work here is the primary attraction. When you talk to them, many of the "long-time illegals" have no qualms about telling you that they're here illegally. In most cases, they will tell you that they really don't want to become U.S. citizens. Many have families back in Mexico and in other Latin American countries and they are here to make money and send it back home to their families. I had an electrician tell me that many who have their families here will make as much money as they can so they can retire to Mexico and live like a king because the standard of living is so much lower. Generally, its the teens that grow up in this country and have no ties to a homeland that want to stay. And, because of their birth on U.S. soil, they are already citizens.

So, to me, a pathway to citizenship and just paying some fine for coming into this country illegally isn't going to solve the problem. Many don't want citizenship and, by being here, they will continue to suppress wages. We need a guest worker program. We need to go after those employers who keep hiring illegals; because, if the jobs aren't here, they won't come. Finally, we need to deport those families we find here. But, what Obama and the Democrats are proposing, may actually accelerate illegal immigration.

Come Be Indentured In San Francisco

Recently, the City of San Francisco decided to start airing television and radio commercials and billboard advertisements that are designed to tell illegal aliens that they are welcome in their "fair" city (See Full Story). In those ads, San Francisco proudly declares itself a "sanctuary city" where illegal aliens can work without the fear of police harassment and in a city that won't snitch to ICE (Immigration and Customs Enforcement) about them. As a further enticement, they tell the illegals about all the city services they can expect to get when they come to San Francisco. In essence, they want illegals to know that San Francisco is their "promised land" and their "land of milk and honey!" I'm not sure, but, I think these ads should have the background theme playing of this famous Scott McKenzie song:

I don't know who the City of San Francisco thinks they are kidding. The extremely liberal Mayor and City Council isn't interested in making a home for all these people because of some higher belief that this country should have an "open door" policy on immigration. Instead, I think their motives are selfish. San Francisco is one, if not the most, affluent of cities in our country. They need the cheap labor to walk their dogs and pickup after them. They've got mansions and hotels to clean and landscapes to be meticulously maintained. And, the rich locals (and their kids) "ain't" gonna do it.

There's no fear that these immigrants are going to settle-in. They don't have the education to take the jobs away from the San Francisco elite. Also, these "immigrants" could never afford the rent so as to be actual residents . A one-bedroom studio apartment in that city runs a minimum of $1200 a month; with most approaching $2000 a month.(See Full Story). Making only a few dollars an hour, they would be one rich " illegal" if they could even hope to get $1200 in any given month. Even at minimum Federal wage, they couldn't afford housing in that city. The only way they could afford to rent in the city limits of San Francisco is to pile about 10 or more of them into a room. And, I am quite sure those San Francisco landlords, those "gentle people there", aren't going to put up with that. Of course, these "illegals" could "commute" to better serve the San Francisco natives and their rituals of the rich. But, gasoline prices of nearly $5 a gallon in the "Bay" area might stymie that. Further, they might not be as protected outside the friendly confines of the "Sanctuary By the Bay". Without that protection, they could wind up leaving their "heart" and their "job" in San Francisco while some other city and ICE gladly deport their ass back to Guadalajara!

Yes, San Francisco is a "sanctuary" city for servitude. If you are illegal, you can go to San Francisco and you will be indentured without any chains. The contract for indenture is a simple one: they'll keep "quiet" if you just keep working and making "them" happy. They need cheap, menial labor that will keep San Francisco in the style it has always been accustomed to. Cheap labor that has always been part of San Francisco's history. One that stretches all the way back to the legal and illegal steamships that brought Chinese immigrants to San Francisco in the 1800's.

As a final comment. Most illegals don't just come here for themselves. They come to feed their families back home. They need to live cheap and work as many hours as they can to help a lot more than themselves. Most have to send money back home. This seems to be missing in San Francisco calculations to be a "sanctuary" city. With that city's wealth and the inability for illegals to actually live there, San Francisco is bound to attract the wrong kind of illegals than those that they really want. The ones that they will ultimately attract might be "a lot more illegal" than just illegally coming over our boarders and illegally obtaining a false I.D. Mark my words!

Open Immigration? I Don't Think So!

While not as hot a topic as it had been just a few months ago, illegal immigration still gets plenty of media time. Usually, the general topic involves whether or not our Federal government should raid businesses with high levels of suspected illegals. Many of those arguing against this action believe that Hispanics from Mexico and Central and South America "should be" free to come and go. An open border system.

Instead of us arguing about all those "well worn" problems and costs associated with illegal immigration, I would propose that we look at this issue from a different angle. Let's say, hypothetically, that we abandon all of our immigration policies and controls. What then? What if we just opened up our borders without any restrictions? What would be the impact on our economy if another ten million immigrants came into this country? How about another twenty million or thirty million; or, even higher? And, let's not forget that we currently have about 15 million Americans who are out of work.

I think that the reality of doing so would be a total economic and social disaster. A disaster that this country could never recover from. We would be swamped with a flood of non-English speaking, uneducated, and untrained workers and their families. Our health care system would collapse from a tsunami of the uninsured. Our school systems, which can barely survive now, would implode. Unemployment would skyrocket to double or triple what it is now. The average American salary would suffer, too, as the immigrant population would be so hungry for work that they would be willing to undercut the pay for any job; not just those jobs that Americans aren't willing to take. And, our employers will be happy to oblige them if the criminal repercussions in doing so were all gone. Lastly, crime would be rampant as millions would be without any income.

For those who think that our borders should be wide open, just think about the true consequences of doing so. Let's not think that a flood of uncontrolled immigrants would be beneficial to this country; because, it just wouldn't. While it is true that we are a country of immigrants, we did so over time. Not overnight! Therefore, we need to come to a reasonable solution that would provide for "controlled" work entry into this country, with guaranteed jobs, and without destroying the economic and social strengths that have attracted so many to our borders.
